Terms of Service

These terms govern your use of Layersmith ("the Service"), operated as a sole proprietorship in British Columbia, Canada ("we"). By using the Service you agree to them. The short version: your images are yours, pay only for what's labelled paid, don't abuse the Service, and we'll be straight with you.
Your content
You own the images you open and the files you export. You warrant that you have the rights to the images you process. We claim no license over your content beyond the minimum needed to operate the features you invoke (e.g., transmitting an image to our servers when you click a server-AI button). We do not train AI models on your images.
AI-generated fill regions are labelled with an AI_Fill_ prefix in exported files. You are responsible for how you use AI-modified images, including any disclosure obligations that apply to your work.
Plans, credits, and caps
- Free: the full local pipeline; free background removal; unlimited ORA and PNG-stack exports; a daily cap on PSD exports; and a one-time grant of 14 server-AI credits when you sign up, with no card required. Those credits cover every server feature except HD generative fill, which runs on a paid third-party engine and needs purchased credits.
- Monthly plans: recurring subscriptions. A plan makes the everyday server tools — background removal, object erase, layer splitting and text scanning — unrestricted rather than credit-metered, subject to a fair-use ceiling, and lifts the daily PSD cap entirely. Each plan also grants a set number of credits every month for the HD generative engines and print-ready colour separation, which are metered for everyone because they carry a real third-party cost. Plans renew monthly and you can cancel anytime. Current prices and credit allowances are shown on the pricing page, in your own currency.

We cap quantity, never quality: no exports are ever watermarked or degraded.
Billing and refunds
Purchases are sold through Link, a Stripe company, as merchant of record. Link is the seller on the transaction: it takes the payment, charges and remits any sales tax, VAT or GST due where you live, and issues the receipt. Your card statement will show LINK.COM* LAYERSMITH, and the checkout page says “Sold through Link”. You can view your orders and manage subscriptions at link.com. We never see your card number.
Plans are monthly subscriptions that renew automatically until you cancel — cancel anytime from your account and you keep access through the end of the paid month. The top-up pack is a one-time purchase that does not recur.
14-day no-questions refund on any first purchase: email us within 14 days and we'll refund it. Because Link is the merchant of record, it also handles payment-related support and may issue a refund itself within 60 days of a purchase — so you can ask either of us. Prices shown exclude tax unless stated; any tax due is added at checkout and shown before you pay.
Acceptable use
Don't use the Service to process content that is illegal, that infringes others' rights, or to attack the Service itself (scraping the API, circumventing metering, reselling access). We may suspend accounts doing so; we'll tell you why — except where the next section applies.
Child safety — zero tolerance
Uploading, processing, or attempting to process child sexual abuse material (CSAM) or any content that sexualizes minors is absolutely prohibited. Enforcement today is report- and review-driven rather than automated: we do not currently hash-match uploads against known-CSAM databases, though we intend to, and our Privacy Policy describes exactly what happens now. On detection, report, or reasonable belief: the account is terminated immediately and permanently, without notice, refund, or appeal; the material and associated account information are preserved as evidence; and a report is made to the Canadian Centre for Child Protection (Cybertip.ca) and/or the National Center for Missing & Exploited Children, and to law enforcement, as required by law. Account deletion and anonymization do not apply to information subject to such preservation. There is no legitimate use of this Service that involves such material.
How server AI handles your images
Single-image server features process your pixels transiently on our server AI and store no copy. Images you choose to send us with the “send us this image” button are stored for a maximum of 24 hours and then deleted automatically; only file names, counts, and timestamps are retained as job records. Full details are in the privacy policy.
Service quality
AI segmentation and inpainting are probabilistic — results vary with the image, and we don't guarantee any particular output. The Service is provided "as is"; to the maximum extent permitted by law our total liability is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited under applicable law.
Changes
We may update these terms; material changes will be announced on the site or by email at least 14 days before they take effect. Continued use after that constitutes acceptance.
Governing law
These terms are governed by the laws of British Columbia and the federal laws of Canada applicable therein. Disputes go to the courts of British Columbia.
